Rhode Island Home Growing Rules

3 mature and 3 immature plants per residence — not per person. Indoor only, no greenhouses. Medical patients get 12+12 with plant tags.

Recreational Home Cultivation

Under the RI Cannabis Act, adults 21 and older may grow cannabis at home with these specific limits:

The critical distinction: the limit is per residence, not per person. Two adults living together cannot grow 6 mature plants each — the household total remains 3 mature and 3 immature regardless of how many adults reside there.

Indoor Only — No Outdoor Growing

Rhode Island is one of the stricter legal states on growing location. Cannabis must be cultivated entirely indoors in a fully enclosed, locked space. This means:

  • Greenhouses do not qualify. Even fully enclosed greenhouse structures are not considered "indoor" under the RI Cannabis Act. The grow space must be within your residence or an attached structure with permanent walls, roof, and a locking door.
  • No backyard grows. Outdoor cultivation is prohibited regardless of fencing, privacy screens, or property size.
  • Garages and basements qualify as long as they are part of the residence, fully enclosed, and have a lock preventing access by minors or unauthorized persons.
  • Detached sheds on your property may qualify if they meet the locked, enclosed requirements, but enforcement varies by municipality.
Greenhouses Don't Count

This trips up many growers. Even a fully enclosed, locked greenhouse with solid walls does not qualify as "indoor" cultivation under Rhode Island law. Your grow must be inside your residence or an attached permanent structure. Outdoor growing of any kind is prohibited.

Medical Patient Cultivation

Registered medical marijuana patients receive significantly expanded growing rights:

Medical patients must register their cultivation site with the state and affix plant tags to each plant. Tags are obtained through the medical marijuana program and must be visible for inspection. Growing without tags — even as a registered patient — can result in the loss of patient privileges.

Landlord Rights

If you rent your home, your landlord has the right to prohibit home cultivation entirely. This applies to all rental properties, including single-family homes and apartments. Check your lease — many Rhode Island leases now include explicit cannabis cultivation prohibitions. Growing in violation of a lease prohibition can be grounds for eviction.

Harvested Cannabis Storage

All cannabis harvested from home-grown plants counts toward the 10-ounce home storage limit. Harvested material must be stored in a secure, locked container not accessible to persons under 21. If your harvest exceeds 10 ounces, you must dispose of the excess — there is no exception for home growers.
