Possession Penalties by Amount
Rhode Island uses a tiered system that escalates rapidly once you exceed the legal limits. The RI Cannabis Act made possession of up to 1 ounce legal for adults 21+, but anything above that enters civil or criminal territory:

The jump from misdemeanor to felony at 1 kilogram (about 2.2 pounds) is dramatic. At that threshold, Rhode Island imposes a 10-year mandatory minimum — meaning a judge cannot sentence below 10 years regardless of circumstances. This is one of the harsher escalation points among legal states.
Distribution & Trafficking Penalties
Unlicensed distribution carries separate, often harsher penalties than possession:
- Any amount (unlicensed sale): Felony — up to 30 years and $100,000 fine for a first offense.
- Distribution to a minor: Doubled penalties and mandatory minimum sentences. Selling to anyone under 18 carries a minimum 2-year sentence.
- Distribution near schools/parks: Enhanced penalties within 300 yards of schools, playgrounds, or public parks. Sentences doubled.
- Repeat distribution offenses: Second offense triggers mandatory minimum sentences with no possibility of probation or suspended sentence.
Adult sharing (gifting) of up to 1 ounce between adults 21+ remains legal under the RI Cannabis Act, provided no compensation of any kind is exchanged.
Under-21 Violations
Persons under 21 face civil violations rather than criminal charges for small amounts:

Rhode Island's decriminalization framework (in place since 2013) ensures that small-amount possession by minors remains a civil matter. However, quantities above 1 ounce trigger the same criminal escalation as for adults.
Rhode Island's mandatory minimum sentences for amounts above 1 kg cannot be reduced by a judge for any reason — no good behavior credit, no first-offender leniency, no plea bargaining below the minimum. At 1–5 kg, you face a minimum 10 years in prison.
Paraphernalia
Since legalization, possession of cannabis paraphernalia (pipes, rolling papers, vaporizers) by adults 21+ is fully legal. Paraphernalia charges can still apply to persons under 21 or in conjunction with amounts exceeding legal limits.
